1. About these terms
These Terms of Use (the “Terms”) govern your use of purebariatric.com, the PureBariatric Nutrition Journal web app, and any future PureBariatric mobile applications (collectively, the “Services”). The Services are operated by 2800977 Alberta Inc. (“PureBariatric,” “we,” “us”).
By accessing or using the Services you agree to these Terms and to our Privacy Policy. If you do not agree, please discontinue use.
2. Eligibility
You must be at least 18 years old to use the Services. If we offer paid coaching in the future, coaching is currently available only to residents of Canada. Use of educational content elsewhere in the world is permitted but you do so on your own initiative and at your own risk.
3. Educational use only — not medical advice
The Services provide general health education based on publicly available clinical guidelines and peer-reviewed literature. The Services are not:
- medical advice, medical care, diagnosis, or treatment
- nursing care or professional nursing advice
- individualized dietetic advice, meal planning, or nutrition prescription
- mental-health therapy, counseling, or psychological care
- legal, tax, or financial advice
- a substitute for the care of your own bariatric team, physician, nurse practitioner, registered dietitian, pharmacist, psychologist, or other licensed clinician
- emergency care — for urgent symptoms, call your local emergency number or attend the nearest emergency department
No professional relationship of any kind is created by your use of the Services. You should always follow the personalized guidance of your own qualified healthcare providers.
PureBariatric is not affiliated with, endorsed by, certified by, or partnered with ASMBS, Obesity Canada, AACE, TOS, ISSN, Alberta Health Services, the College of Registered Nurses of Alberta, or any other clinical, regulatory, professional, or governmental organization. References to these organizations on the Services are factual citations of their publicly available work.
4. Use of free tools
The protein calculator, hydration calculator, supplement checklist, and any other educational tools we publish are illustrative starting estimates derived from published clinical guidelines. They are not a personalized prescription or care plan. Your individualized targets must come from your own bariatric team.
Inputs you provide to the tools are processed in your browser. We do not transmit those values to our servers. See the Privacy Policy for details.
5. Accounts and registrations
Some features may require you to register, subscribe to launch notifications, or create an account. You agree to provide accurate information and to keep your contact details current. You are responsible for activity that occurs under your account.
6. Payments and refunds
Where the Services include paid products, subscriptions, or coaching, the price, billing cycle, and refund policy applicable to that product will be disclosed at the point of purchase. Payments are processed by Stripe, Apple, or Google as applicable; their terms also apply to those transactions. Coaching engagements have their own coaching agreement, intake form, and consent documents that will be provided in writing before you enroll.
7. Intellectual property
The Services and all content we author — text, calculators, layouts, design, images we have licensed or created, and code — are owned by 2800977 Alberta Inc. or licensed to us. You may view, share, and link to our publicly accessible educational content for personal, non-commercial use, with attribution.
You may not:
- copy, scrape, or republish substantial portions of our content
- use our content to train machine-learning models without written permission
- remove or alter copyright, trademark, or disclaimer notices
- use the “PureBariatric” name or logo in a way that suggests endorsement or affiliation
Third-party clinical guidelines we cite (such as ASMBS, Obesity Canada, AACE/TOS, ISSN) remain the intellectual property of their respective publishers. We paraphrase and link to those works rather than reproduce them.
8. Acceptable use
You agree not to:
- use the Services in any way that violates Canadian, provincial, or applicable foreign law
- impersonate any person or misrepresent your identity
- attempt to gain unauthorized access to the Services or any related systems
- interfere with site security, performance, or other users’ experience
- use the Services to give medical, nursing, dietetic, or any other professional advice to other people
9. Third-party links and services
The Services may link to or rely on third-party websites and services (including hosting providers, analytics, search engines, video platforms, payment processors, and citation sources). We do not control and are not responsible for the content, policies, or practices of those third parties.
10. Privacy
Your use of the Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
11. Disclaimer of warranties
The Services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, PureBariatric and 2800977 Alberta Inc. disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, and uninterrupted availability. We do not warrant that the Services or any calculator outputs are appropriate for your specific clinical situation.
12. Limitation of liability
To the maximum extent permitted by law:
- PureBariatric and 2800977 Alberta Inc. are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or opportunity arising out of or related to your use of the Services.
- Our aggregate liability for any direct damages arising out of or related to the Services is limited to the greater of (a) the total amount you paid us in the twelve (12) months before the event giving rise to the claim, or (b) one hundred Canadian dollars (CAD $100).
- Nothing in these Terms excludes or limits liability that cannot be excluded or limited by applicable law (for example, liability for gross negligence, willful misconduct, fraud, or bodily injury caused by negligence where such limitation is prohibited).
13. Indemnity
You agree to indemnify and hold harmless PureBariatric, 2800977 Alberta Inc., and our officers, directors, employees, and contractors from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of (a) your use of the Services, (b) your violation of these Terms, or (c) your violation of any applicable law or the rights of any third party.
14. Governing law and jurisdiction
These Terms are governed by the laws of the Province of Alberta, Canada, and the federal laws of Canada applicable in Alberta, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction of the courts located in Alberta for any dispute arising from or relating to these Terms or the Services, except where such jurisdiction selection is unenforceable under the consumer-protection law of your province or country of residence.
15. Changes to these terms
We may update these Terms from time to time. When we make a material change, we will update the “Effective date” at the top of the page and, where appropriate, notify users by email. Your continued use of the Services after a change indicates acceptance of the updated Terms.
